1. Acceptance of Terms

By downloading, installing, or using Onfoot ("the App"), you agree to be bound by these Terms of Use ("Terms"). If you do not agree to these Terms, do not use the App.

These Terms constitute a legal agreement between you and Dan Urbánek ("Developer", "we", "us"), the individual developer of Onfoot. These Terms apply to all versions of the App, including the iOS app, the Apple Watch companion app, and associated widgets.

2. Description of the App

Onfoot is a step-tracking and pedometer application for iPhone and Apple Watch that reads your walking activity from Apple Health and turns it into a motivating, gamified experience. Features include:

• Step tracking — daily, weekly, and historical step counts from Apple Health
• Gamification — badges, missions, streaks, and challenges to keep you motivated
• Widgets — Home Screen, Lock Screen, and Standby widgets showing live step progress
• Apple Watch companion — view your steps and progress directly on your wrist via the watchOS app

The App is available on:

• iOS 17 or later (iPhone)
• watchOS 10 or later (Apple Watch — companion app)

The App requires access to Apple Health (HealthKit) to provide its core functionality. Without granting HealthKit permission, step data and most features will not be available.

4. App Provided "As-Is"

The App is provided on an "as-is" and "as available" basis without warranties of any kind, either express or implied, including but not limited to:

• Warranties of merchantability or fitness for a particular purpose
• Uninterrupted or error-free operation
• Accuracy of step counts or health data (which originate from Apple Health sensors)
• Compatibility with all future iOS or watchOS versions
• Continuous availability of all features

To the maximum extent permitted by applicable law, the Developer disclaims all liability for any damages arising from your use of the App.

5. Premium Features & Subscriptions

5.1 Pricing

Onfoot offers optional Premium access through the following in-app purchase options:

Prices are displayed in USD. Actual pricing in your local currency may vary based on your App Store region and is set by Apple. The Developer reserves the right to update pricing with advance notice via Apple's standard subscription notification mechanisms.

5.2 Free Trial

Monthly and Yearly subscriptions include a 7-day free trial for new subscribers. You will not be charged during the trial period. If you do not cancel before the trial ends, your subscription will automatically begin and your payment method will be charged at the applicable rate.

• All payments are processed by Apple via the App Store using StoreKit 2
• The Developer never has access to your payment details, credit card numbers, or billing information
• Your payment method is charged upon confirmation of purchase or at the end of a free trial period
• You can manage payment methods in your Apple ID account settings

5.5 Refund Policy

6. Intellectual Property

All content, design, code, graphics, icons, badge artwork, animations, gamification elements, and other materials in the App are the exclusive intellectual property of Dan Urbánek, unless otherwise stated.

• You may not copy, modify, distribute, sell, or sublicense any part of the App
• You may not reverse engineer or attempt to extract the source code of the App
• You may not create derivative works based on the App or its content
• The "Onfoot" name, logo, and branding are proprietary to the Developer

Your use of the App grants you a limited, non-exclusive, non-transferable, revocable licence to use the App for personal, non-commercial purposes in accordance with these Terms.

7. Acceptable Use

You agree not to use the App to:

• Violate any applicable law or regulation
• Attempt to gain unauthorised access to any part of the App or its infrastructure
• Reverse engineer, decompile, or disassemble the App
• Interfere with the App's intended functionality or user experience
• Manipulate or falsify health data in a way that could harm others
• Use the App for any commercial purpose without the Developer's prior written consent

8. Apple Health & HealthKit

The App reads step and activity data from Apple Health (HealthKit) to provide its core functionality. By granting HealthKit permission:

• You acknowledge that step and activity data will be read from Apple Health on your device
• You understand this data is processed locally and is never transmitted to the Developer or any third party
• You confirm that Onfoot has read-only access — it will never modify or delete data in Apple Health
• You can revoke HealthKit permission at any time in iOS Settings → Privacy & Security → Health → Onfoot

9. App Updates & Discontinuation

The Developer reserves the right to:

• Release updates that change, add, or remove features at any time
• Require you to update the App to continue using it
• Discontinue the App with reasonable notice where possible
• Modify these Terms at any time — continued use of the App constitutes acceptance of updated Terms

In the event the App is discontinued, active subscribers may be entitled to a pro-rata refund through Apple for the unused portion of their subscription period, subject to Apple's refund policies and applicable law.

10. Limitation of Liability

To the maximum extent permitted by applicable law, the Developer shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to:

• Loss of data or inaccurate step/health data
• Personal injury arising from reliance on App data
• Loss of revenue, profits, or business opportunities
• Any damages arising from App unavailability, bugs, or discontinuation
• Any decisions made based on step count or health data displayed in the App

The Developer's total liability to you for any claims arising from these Terms or your use of the App shall not exceed the amount you paid for the App in the twelve months preceding the claim.

11. Governing Law

These Terms are governed by and construed in accordance with the laws of the Czech Republic, without regard to its conflict of law provisions. Any disputes arising from these Terms or your use of the App shall be subject to the exclusive jurisdiction of the courts of the Czech Republic.

If you are a consumer in the EU, you may also have rights under the mandatory consumer protection laws of your country of residence, which these Terms do not affect.

12. Third-Party Terms

By using the App, you also agree to Apple's terms and policies where applicable, including for all in-app purchases processed through the App Store:

• Apple Media Services Terms and Conditions

Apple is not a party to these Terms and bears no responsibility for the App or its content. Apple has no obligation to provide maintenance, support, or warranty for the App.

13. Changes to These Terms

We may update these Terms from time to time. We will notify you of significant changes via app update release notes. The "Effective Date" at the top of this page reflects when the Terms were last updated.

The current version of these Terms is always available at ios.dnesdan.cz/onfoot/terms-of-use. Continued use of the App after changes constitutes acceptance of the new Terms.
