Terms of Use

1. Acceptance of Terms

By downloading, installing, or using Nomina ("the App"), you agree to be bound by these Terms of Use ("Terms"). If you do not agree to these Terms, do not use the App.

These Terms form a legal agreement between you and Dan Urbánek ("Developer", "we", "us"). They apply to all users of the App, regardless of whether you are a free or premium user.

2. About the App

Nomina is an iPhone application that provides name day calendars for European countries. It matches name days against your device contacts, offers local notification reminders, and includes Home Screen widgets, Lock Screen widgets, and Apple Watch support.

• Nameday overview — daily and upcoming namedays for selected countries
• Contact matching — on-device matching of first names from your contacts
• System surfaces — reminders, widgets, and watch complications/widgets
• Favorites and sync — optional favorite syncing through your personal iCloud account

3. Eligibility

• You must be at least 13 years of age to use the App
• You must have a compatible iPhone running iOS 18.0 or later
• You must comply with Apple's App Store terms and your local laws

4. Licence

Subject to these Terms, the Developer grants you a limited, non-exclusive, non-transferable, revocable licence to use the App for personal, non-commercial purposes.

You may not:

• Copy, modify, distribute, sell, or sublicense the App
• Reverse engineer, decompile, or attempt to extract the source code
• Create derivative works based on the App
• Use the App for any commercial purpose without prior written consent
• Remove any proprietary notices or labels from the App

5. Free Tier & Premium Purchase

5.1 Free Tier

The free tier includes:

• Daily name day overview for selected countries
• Contacts matching
• Name search
• Basic widgets

5.2 Premium — One-Time Purchase

• The purchase unlocks additional reminder and widget customization, extended features, and future premium additions
• The licence is tied to your Apple ID and can be used on all your personal devices
• All transactions are processed securely by Apple via the App Store
• The Developer does not have access to your payment information

5.3 Restore Purchases

If you reinstall the App or switch devices, you can restore your premium purchase at any time using the "Restore Purchases" option in the App — at no additional cost.

5.4 Pricing

The current price for the premium upgrade is displayed within the App before purchase, in your local currency as determined by Apple's App Store pricing tiers. Prices may vary by region.

6. Name Day Data Accuracy

Name day traditions vary by region and may change over time. If you find an error, please report it via email so it can be reviewed and corrected in a future update.

7. Contacts & Notifications

The App may request permission to access your contacts and send local notifications. By granting these permissions:

• You acknowledge that contact first names are read locally to match against name day calendars
• You understand that contact data never leaves your device
• You confirm that notifications are scheduled locally with no push notification server
• You can revoke either permission at any time in iOS Settings

8. Widgets, Apple Watch, and iCloud sync

Nomina includes widgets, watch surfaces, and optional favorites sync. By using these features, you acknowledge that:

• Widget and watch content is derived from the data available on your device and within Apple's shared containers
• Apple controls refresh timing for widgets and some watch surfaces, so updates may not appear instantly
• Favorites sync, when enabled, uses Apple's CloudKit infrastructure tied to your personal iCloud account
• The Developer does not operate a custom sync backend or guarantee immediate cross-device propagation

9. Privacy

Your use of the App is also governed by our Privacy Policy, which is incorporated into these Terms by reference.

In summary: we do not collect, store, or transmit personal data. The App is privacy-first by design.

10. Disclaimer of Warranties

The App is provided "as is" and "as available" without any warranties of any kind, either express or implied, including but not limited to:

• Fitness for a particular purpose
• Accuracy or completeness of name day data
• Uninterrupted or error-free operation
• Compatibility with all iOS devices or future iOS versions

11. Limitation of Liability

To the maximum extent permitted by applicable law, the Developer shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to:

• Incorrect or missing name day information
• Missed notifications or reminders
• Loss of locally stored preferences or settings
• Delayed widget, watch, or iCloud sync refresh behaviour controlled by Apple systems
• Damages arising from App unavailability, bugs, or discontinuation

The Developer's total liability for any claims arising from these Terms or your use of the App shall not exceed the amount you paid for the App.

12. Acceptable Use

You agree not to use the App to:

• Violate any applicable law or regulation
• Attempt to gain unauthorised access to any part of the App
• Interfere with the App's intended functionality
• Use the App for any commercial purpose without written consent

13. App Updates & Discontinuation

The Developer reserves the right to:

• Release updates that change, add, or remove features at any time
• Require you to update the App to continue using it
• Discontinue the App with reasonable notice where possible
• Modify these Terms at any time — continued use constitutes acceptance

14. Intellectual Property

All content, design, code, icons, and other materials in the App are the intellectual property of Dan Urbánek, unless otherwise stated. The "Nomina" name and branding are proprietary to the Developer.

15. Apple & Third-Party Terms

By using the App, you also agree to Apple's applicable terms and policies:

• Apple Standard End User Licence Agreement (EULA)
• Apple Privacy Policy
• Apple Media Services Terms and Conditions

Apple is not a party to these Terms and bears no responsibility for the App or its content. Apple has no obligation to provide maintenance, support, or warranty for the App.

16. Governing Law

These Terms are governed by and construed in accordance with the laws of the Czech Republic, without regard to its conflict of law provisions. Any disputes arising from these Terms or your use of the App shall be subject to the exclusive jurisdiction of the courts of the Czech Republic.

If you are a consumer in the EU, you may also have rights under the mandatory consumer protection laws of your country of residence, which these Terms do not affect.

17. Changes to These Terms

We may update these Terms from time to time. We will notify you of significant changes via app update release notes. The "Effective Date" at the top of this page reflects when the Terms were last updated.
