1. Acceptance of terms
By downloading, installing, or using Indexsmith ("the App"), you agree to these Terms of Use ("Terms"). If you do not agree, do not use the App.
These Terms form a legal agreement between you and Dan Urbánek ("Developer", "we", "us"). They apply to the iOS and iPadOS versions of Indexsmith and related premium purchase flows.
2. What the app does
Indexsmith is an ASO research and analysis tool for App Store work. It helps you inspect public listing signals, public reviews, keyword patterns, competitor positioning, metadata direction, and market spread.
- Research tools — keyword scouting and multi-market scans
- App workbench — listing, reviews, competitors, AI summaries, pricing, and history
- Metadata drafting — title, subtitle, keyword, and release-note support
- Notebook and journal — local notes and saved analysis artifacts
3. Decision-support disclaimer
Indexsmith is a decision-support tool, not a guarantee engine.
The App uses heuristic scoring, model-generated summaries, and public-store data to help with ASO judgment. Rankings, revenue outcomes, conversion changes, and competitive outcomes are inherently uncertain. You remain responsible for business decisions, experiments, store submissions, and compliance.
4. Public data and third-party systems
The App may access Apple-provided public App Store information and Apple-managed purchase systems. Availability, quality, and completeness of public-store data may change over time. The Developer is not responsible for Apple outages, missing storefront data, review truncation, or regional App Store inconsistencies.
5. Premium features and billing
Indexsmith may offer premium features through Apple's in-app purchase systems. Product availability, plan type, and pricing can vary by build, storefront, or release.
- All purchases are processed by Apple
- Current pricing is shown in the App Store or in the in-app purchase sheet presented by Apple
- Subscriptions, if offered, renew and cancel according to Apple's rules and your App Store settings
- Refunds are handled by Apple, not by the Developer directly

6. Your use of the app
You agree not to use Indexsmith to:
- Violate any law, platform rule, or contractual restriction
- Attempt to reverse engineer, scrape, or abuse third-party systems through the app in ways the app was not designed to support
- Redistribute the app, its code, or its proprietary presentation without permission
- Misrepresent heuristic outputs as guaranteed factual claims from the Developer
7. Intellectual property
Unless otherwise stated, the App's code, branding, design, copy, and original analysis presentation are the intellectual property of Dan Urbánek. Your use of the app grants a limited, non-exclusive, non-transferable licence to use the app in accordance with these Terms.
8. No account service commitment
Indexsmith is built without a user account backend. The Developer does not guarantee cross-device sync, hosted workspace recovery, or indefinite retention of locally stored research if you delete the app or replace your device.
9. App provided as-is
The App is provided on an as-is and as-available basis without warranties of any kind, to the maximum extent allowed by law. This includes no warranty that the App will be uninterrupted, error-free, commercially effective, or fit for any particular business purpose.
10. Limitation of liability
To the maximum extent permitted by law, the Developer is not liable for indirect, incidental, consequential, or special damages arising from use of the App, including missed rankings, lost revenue, submission issues, data loss on your device, or strategic decisions made from App output.
If applicable law does not allow complete exclusion, the Developer's total liability will be limited to the amount you paid for the App in the twelve months before the claim.
11. Governing law
These Terms are governed by the laws of the Czech Republic, without regard to conflict-of-law rules. Consumers may still benefit from mandatory protections in their home jurisdiction where applicable.

These Terms may be updated from time to time. The current version is always available at ios.dnesdan.cz/indexsmith/terms-of-use. Continued use of the App after an update constitutes acceptance of the revised Terms.
