Terms of Use

1. Acceptance of Terms

By downloading, installing, or using Fix My Treadmill ("the App"), you agree to be bound by these Terms of Use ("Terms"). If you do not agree to these Terms, do not use the App.

These Terms apply to all users of the App, regardless of whether you are a free or premium user.

2. About the App

Fix My Treadmill is an iOS application developed by Dan Urbánek ("Developer", "we", "us") that helps users correct inaccurate distance data recorded during indoor treadmill and cycling workouts in Apple Health (HealthKit).

3. Eligibility

• You must be at least 13 years of age to use the App (4+ rating, but HealthKit requires 13+)
• You must have a compatible iPhone running iOS 17.0 or later
• You must comply with Apple's App Store terms and your local laws

4. Licence

Subject to these Terms, the Developer grants you a limited, non-exclusive, non-transferable, revocable licence to use the App for personal, non-commercial purposes.

You may not:

• Copy, modify, distribute, sell, or sublicense the App
• Reverse engineer, decompile, or attempt to extract the source code
• Create derivative works based on the App
• Use the App for any commercial purpose without prior written consent
• Remove any proprietary notices or labels from the App

5. Free Tier & Premium Purchase

5.1 Free Tier

The App includes 3 free workout fixes at no cost, allowing you to try the core functionality before purchasing.

5.2 Premium — One-Time Purchase

• The purchase unlocks unlimited workout corrections
• The licence is tied to your Apple ID and can be used on all your personal devices
• All transactions are processed securely by Apple via the App Store
• The Developer does not have access to your payment information

5.3 Restore Purchases

If you reinstall the App or switch devices, you can restore your premium purchase at any time using the "Restore Purchases" button in the App — at no additional cost.

5.4 Pricing

The current price for the premium upgrade is displayed within the App before purchase, in your local currency as determined by Apple's App Store pricing tiers. Prices may vary by region.

6. HealthKit & Health Data

The App reads and writes workout data using Apple Health (HealthKit). By granting HealthKit permission:

• You acknowledge that indoor workout data will be read from Apple Health on your device
• You understand that corrected workouts are saved as new copies back to Apple Health — the original workout is never deleted or modified
• You confirm that all data processing happens entirely on your device — no health data is ever transmitted to the Developer or any third party
• You can revoke HealthKit permission at any time in iOS Settings → Privacy & Security → Health → Fix My Treadmill

7. Notifications

The App may request permission to send local notifications to alert you when new indoor workouts are detected. Notifications are generated entirely on your device and do not involve any external servers. You can disable notifications at any time in iOS Settings.

8. Privacy

Your use of the App is also governed by our Privacy Policy, which is incorporated into these Terms by reference.

In summary: we do not collect, store, or transmit any personal data. The App is privacy-first by design.

9. Disclaimer of Warranties

The App is provided "as is" and "as available" without any warranties of any kind, either express or implied, including but not limited to:

• Fitness for a particular purpose
• Accuracy or completeness of workout distance corrections
• Uninterrupted or error-free operation
• Compatibility with all iOS devices or future iOS versions

Workout distance corrections are based on the value you manually enter. The Developer is not responsible for incorrect values entered by the user.

10. Limitation of Liability

To the maximum extent permitted by applicable law, the Developer shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to:

• Loss or corruption of health or workout data in Apple Health
• Inaccurate workout corrections resulting from user input errors
• Any decisions made based on corrected workout data
• Loss of revenue, profits, or business opportunities
• Damages arising from App unavailability, bugs, or discontinuation

The Developer's total liability for any claims arising from these Terms or your use of the App shall not exceed the amount you paid for the App.

11. Acceptable Use

You agree not to use the App to:

• Violate any applicable law or regulation
• Falsify health or workout data to deceive others (e.g., for competitions)
• Attempt to gain unauthorised access to any part of the App
• Interfere with the App's intended functionality
• Use the App for any commercial purpose without written consent

12. App Updates & Discontinuation

The Developer reserves the right to:

• Release updates that change, add, or remove features at any time
• Require you to update the App to continue using it
• Discontinue the App with reasonable notice where possible
• Modify these Terms at any time — continued use constitutes acceptance

13. Intellectual Property

All content, design, code, icons, animations, and other materials in the App are the intellectual property of Dan Urbánek, unless otherwise stated. The "Fix My Treadmill" name and branding are proprietary to the Developer.

14. Apple & Third-Party Terms

By using the App, you also agree to Apple's applicable terms and policies:

• Apple Standard End User Licence Agreement (EULA)
• Apple Privacy Policy
• Apple Media Services Terms and Conditions

Apple is not a party to these Terms and bears no responsibility for the App or its content. Apple has no obligation to provide maintenance, support, or warranty for the App.

15. Governing Law

These Terms are governed by and construed in accordance with the laws of the Czech Republic, without regard to its conflict of law provisions. Any disputes arising from these Terms or your use of the App shall be subject to the exclusive jurisdiction of the courts of the Czech Republic.

If you are a consumer in the EU, you may also have rights under the mandatory consumer protection laws of your country of residence, which these Terms do not affect.

16. Changes to These Terms

We may update these Terms from time to time. We will notify you of significant changes via app update release notes. The "Effective Date" at the top of this page reflects when the Terms were last updated.
