1. Acceptance of Terms

By downloading, installing, and using SnoreStop (the "App"), you agree to be bound by these Terms of Use. If you do not agree, do not use the App. Dan Urbánek ("Developer", "we", "us") reserves the right to modify these terms at any time. Your continued use of the App constitutes acceptance of any changes.

2. Description of the App

SnoreStop is an iOS app designed to help users reduce snoring through daily throat and tongue exercises. The app includes:

• Daily exercise routines — guided throat and tongue exercises
• Progress tracking — monitors completed exercise sessions and streaks
• Exercise reminders — notifications to encourage daily practice
• Statistics dashboard — view personal exercise history and progress
• Premium features — additional exercise variants and advanced analytics (subscription-based)

System Requirements: iOS 16+ for full functionality.

4. App Provided As-Is

The App is provided on an "as-is" and "as-available" basis without warranty of any kind. The Developer makes no representation or warranty that:

• The App will meet your expectations
• The App will be uninterrupted or error-free
• Any defects will be corrected
• The exercises will reduce snoring or have any medical effect
• The App is suitable for your specific health condition

Auto-Renewal & Cancellation

• Monthly and Yearly plans renew automatically at the end of each billing period
• The 7-day free trial for Yearly plan converts to a paid subscription unless canceled before trial ends
• Cancel anytime in iOS Settings > [Your Name] > Subscriptions > SnoreStop
• Cancellations take effect at the end of the current billing period
• No refunds for unused time in your current subscription period

Payment & Refunds

• All payments are processed securely via Apple StoreKit 2
• The Developer never sees your payment information (credit card, billing address, etc.)
• Apple processes all transactions according to their terms
• Refund requests must be submitted directly to Apple at reportaproblem.apple.com

6. Intellectual Property

All content, design, code, exercise routines, and user interface elements of SnoreStop are the exclusive property of Dan Urbánek and are protected by copyright and intellectual property laws. You may not:

• Reproduce, modify, or distribute the App or any part of it
• Reverse-engineer, decompile, or attempt to extract source code
• Copy the App's exercise routines or design
• Use the App for commercial purposes without permission

7. Acceptable Use

You agree not to:

• Use the App for any illegal purpose or in violation of any laws
• Attempt to gain unauthorized access to the App or its servers
• Transmit viruses, malware, or harmful code
• Engage in any form of harassment or abuse
• Modify or tamper with the App's functionality

8. User Responsibilities

You acknowledge that:

• You are responsible for your own health and safety
• SnoreStop exercises should not cause pain; stop immediately if experiencing discomfort
• If you have any underlying throat, neck, or jaw conditions, consult a healthcare provider before using
• Snoring can be a sign of sleep apnea or other serious medical conditions requiring professional evaluation

9. Permissions & Data Access

SnoreStop may request the following permissions:

• Notifications: To send exercise reminders (you can disable anytime in Settings)
• Microphone (optional, currently disabled): For future sleep monitoring features (not active)
• Motion Data (optional, currently disabled): For future sleep tracking features (not active)

You grant explicit permission for each. Revoke permissions anytime in iOS Settings > Privacy.

11. App Updates & Discontinuation

The Developer may update the App with bug fixes, feature improvements, or security updates at any time. Updates may be mandatory for continued use. The Developer also reserves the right to discontinue the App or specific features with reasonable notice. Upon discontinuation, your active subscription will be refunded on a pro-rata basis.

12. Limitation of Liability

To the maximum extent permitted by law, the Developer shall not be liable for any:

• Indirect, incidental, special, consequential, or punitive damages
• Loss of profits, revenue, data, or use
• Health-related claims or injuries arising from using the exercises
• Any damages arising from the App's use or inability to use
• Failure to reduce snoring or prevent sleep disorders

This limitation applies even if the Developer has been advised of the possibility of such damages. Some jurisdictions do not allow limitation of liability, so this may not apply to you.

13. Indemnification

You agree to indemnify, defend, and hold harmless the Developer from any claims, damages, losses, or expenses (including legal fees) arising from your use of the App, violation of these terms, or infringement of any third-party rights.

14. Governing Law

These Terms of Use are governed by and construed in accordance with the laws of Czech Republic, without regard to conflict of law principles. Any legal action or proceeding shall be resolved exclusively in courts located in Czech Republic.

15. Third-Party Terms

By using SnoreStop, you agree to:

• Apple EULA: Terms and Conditions of Apple's App Store and StoreKit
• TelemetryDeck Terms (if analytics enabled): telemetrydeck.com — for optional anonymous usage analytics

16. Changes to These Terms

The Developer may update these Terms of Use at any time. The "Effective Date" at the top will be updated accordingly. Your continued use of the App after changes constitutes acceptance of the new terms. We recommend reviewing these terms periodically.

17. Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall remain in effect, and the invalid provision shall be modified to the minimum extent necessary to make it valid.
